Privacy Rights and Enforcement Act Initiative

Proposition 24, officially the Privacy Rights and Enforcement Act Initiative, is a California ballot proposition that appeared on the ballot for the general election on November 3, 2020.[1] This initiative builds upon the California Consumer Privacy Act (CCPA) of 2018 which established a foundation for consumer privacy regulations.[2] The proposition seeks to enshrine more provisions in California state law ensuring that consumers can direct businesses not to share their personal data, remove the set time period in which violations of this privacy law could be corrected without penalty and create a dedicated agency to enforce state privacy laws.[3]

Specifically, the initiative gives consumers more power over the distribution of their information by letting them tell businesses to limit the use of sensitive data, prohibiting businesses from holding onto their data for longer than necessary, and allowing the government to fine companies up to $7,500 for violating children's privacy laws. In order to monitor and enforce Prop 24, the initiative will create an agency to enforce the privacy laws, investigate violations, and assess penalties of violators. [4]

This measure was approved by a majority of voters.[5]

Background[edit]

The initiative, if approved, would represent an expansion of provisions first laid out by the California Consumer Privacy Act. In addition to the consumer protections, the proposition would create the California Privacy Protection Agency.[2] If established, the agency would share consumer privacy oversight and enforcement duties with the California Department of Justice.[2] Another effect of the initiative's approval would be requiring businesses to obtain permission from consumers younger than 16 before collecting their data and permission from a parent or guardian before collecting data from consumers younger than 13.[6]

The proposition passed with roughly 55% of California voters voting in favor of the measure.[7]
